It’s considered attorney advertising for a New York lawyer to ask a fertility clinic to include him on its website as a referral for representation in assisted reproduction, the state bar said.
But the ad would fall short of being a “prohibited solicitation” because it’s not targeted at a specific group, the New York State Bar Association said Nov. 9.
The lawyer who posed the question wouldn’t be retained by the clinic, the opinion noted.
The conclusion is the latest in a string of opinions clarifying New York’s ad rules, which were amended last June.
